SUMMARY
Kichmarenko S.M. The administrative and legal ensuring of the judiciary independence in Ukraine. - The manuscript.
The thesis for the degree of candidate of juridical sciences, specialty 12.00.07 - administrative law and process; finance law; information law. - Research Institute of Public Law, Kyiv, 2017.
The thesis is based on the theory of administrative law, local and foreign laws and practical achievements of public administration entities. There are new scientific problem solving of development administrative tools in the administrative and legal regulation of the judiciary independence of in Ukraine.
It has been formed the concept of administrative law to ensure the judiciary independence in Ukraine as administrative and legal measures undertaken through certain administrative and legal framework by providing administrative services and the implementation of the management of special public administration to create all conditions for making judges fair humane solutions to prevent exposure through them and provide appropriate conditions for work and building of judges and other members of the judiciary.
It has been revealed the content of administrative law to ensure the judiciary independence in Ukraine. It has been proved that high legal culture of justice and honesty, professionalism, adherence oath and impartial exercise of justice based on the rule of law is an essential and basic element of judicial independence.
It has been analyzed the administrative and legal aspects of the role of the judiciary in the state mechanism.It has been proved that there are internal and external aspects of nature judiciary. It has been identified administrative principles of judicial independence which consist of two levels directly general principle of judicial independence and integrity of judges and organizational principles.
It has been found out that the principle of non-interference in judges judicial decision means that the executive, the legislature, judges who do not conduct the proceedings in a particular case, and individuals are not allowed any pressure, threat or "requests" on judges hearing the case. The principle of a fair trial is a basic natural law criterion of independence of the judiciary, the greater the percentage of citizens who believe that the court takes just decisions, the higher the level of independence of the judiciary and vice versa.
It has been concluded that the administrative and legal status of entities that infringe on the independence of the judiciary in Ukraine under means interconnected complex of administrative duties on assumptions not in interfere into the work of the court (judge), the legal responsibility for committing violations in this sphere (administrative and special-disciplinary) and administrative enforcement measures that facilitate prosecution of such persons to criminal responsibility for violation of judicial independence.
It has been classified of subjects that encroaching on the judiciary independence in Ukraine. The first category classified government politician. The second category includes senior executive and local authorities. Subjects who belong to these two categories are characterized by having a large amount of power, pseudo-credibility in the community and a wide range of connections, giving them the potential to influence the judges. The third category are individuals who usually hire lawyers to protect their interests, and they in turn are trying to bribe the judges, and when it fails resorted to various means of legal casuistry to ruin or at least the maximum delay proceedings in a legal case .
The fourth category referred criminal elements and pseudo-social organizations which are trying to impact on the judges and their families through threats, illegal pressure, even the use of physical violence.It has been disclosed forms of administrative action of ensuring the judiciary independence. There are forms of administration activity of the High Council of Justice, which are ensuring the judiciary independence by strengthening and implementing the practice of law implementation and administrative action for the release of the judiciary of corrupt and those who betrayed the oath of judges, protection and education of judges (especially on bringing judges to disciplinary responsibility), who made no major disciplinary offenses. It has been found out the legal nature of decisions, orders, protocol decisions, orders and instructions of the head of the High Council of Justice, is a form of administration.
It has been exposed, the legal nature of activity and realization of logistical operations. There are the examples of such activities in the judicial independence sphere.
It has been disclosed methods of administrative activities of the public administration in ensuring the judiciary in Ukraine through the negative ways (those that infringe on independence) and positive effects (those provided by the independence of the judiciary).
It has been determined the ways infringement on the judiciary, which are antipodal administrative methods of public administration to ensure the independence of the judiciary. They are the subjects of unlawful influence categorized into: classic, carried out by criminal elements; marginal undertaken by entities that do not meet the case and the decision by the pseudo-civil society; political and law enforcement.
It has been revealed that illegal methods of pressure on the judiciary, as the opposite methods of administrative public administration to ensure the independence of the judiciary are: illegal promotion of judges (bribery, promise to transfer to another more prestigious court); wrongful conviction (blackmail, threats, ordered articles and investigative journalism, picketing court hearings judges insult, defamation, unlawful interrogation assistant judges and court secretaries); unlawful coercion (damage, larceny, kidnapping judges or their family members, causing them bodily harm, murder).
It has been proved that the leading methods of administrative activities to ensure the judiciary independence of the above mentioned dangers are: organizational and security measures (security court premises, public premises judges protect the personal safety of judges and members of his family property); Criminal law (arrest and conviction of criminals who infringe on the judges, the judiciary); organizational and personnel (judges legalized, release, attract disciplinary responsibility of judges only); organizational and public (television explanation other mass media information on the activities of the judicial authorities, filling and placing electronic declarations at the State Agency for Prevention of Corruption); Developing organizational (involvement of the judiciary of the best lawyers ATO members); organizational and material (appropriate material support and trial judges).
It has found out the legal nature of administrative penalties (sanctions) method as a form of administrative enforcement in ensuring the independence of the judiciary.
It has been solved provisions of international legal instruments that define consolidate the principles of independence of justice. The principles of judicial independence are based on analysis of the European experience. It has been revealed that there are two main administrative concepts to ensure the independence of the judiciary, administrative, involving handing that responsibility to the executive authorities and judges, which is to create a special interim body of judicial power, which directly carries out executive and administrative functions and provides administrative services within the judiciary.
It has been revealed the reasons of improper state independence of the judiciary in Ukraine. It is proposed to achieve the proper level of independence of the judiciary should continue judicial reform. It is necessary to rise the minimum age after which a lawyer can apply for the post of judge in 40, to continue to stay age of judges to 75 years, with an option after 65 years to carry out justice on their own load of 50%.
It is necessary to finish the reforms, which are directly related to the judiciary such as the bar, the Security Service of Ukraine, the police and the prosecutor’s office. It is important to subordinate the state executive service to the judiciary.In purpose of absence of criminal pressure on the judges offered include the exclusive competence of the Prosecutor General of Ukraine (deputy), the right to open criminal proceedings by a judge knowingly unjust verdict, judgment, order or decree. The High Council of Justice is to analyze each such proceeding. In the case of pressure on judges, it is important to take organizational and legal measures to protect judges.
It has been improved administrative responsibility in ensuring the independence of the judiciary in Ukraine by supplementing Code of Ukraine on Administrative Offenses Article 185-3-1 "Encroachment on the independence of the judiciary." A specific law is creating proposals for balancing administrative and legal contradictions between the branches (legislative, executive and judicial) of a single government.
