Gutsalyuk O.V. The administrative and legal principles of local courts reformation in Ukraine. - The manuscript.

The new solution to the scientific task concerning the development of principles and administrative tools in the area of administrative and legal reform of local courts in Ukraine were presented on the basis of the theory of administrative law, domestic and foreign legislation, the achievements of the special judicial public administration.

The role of administrative law was formed. It plays a leading role in the reform of the judiciary. It is a significant factor that, at the level of laws and bylaws, specifies and broadens the constitutional norms for the requirements of direct legal implementation regarding the provision of judicial power, and also produces on based on the norms of administrative law, a special administrative tool in the form of forms and methods of administrative activity of public administration and administrative procedures, in particular concerning the appointment and appointment of judges, their appointment to administrative positions, the prosecution and dismissal, the provision of all necessary resources to judges and the creation of conditions for the implementation of humane and fair justice on the basis of the rule of law, the creation of appropriate conditions for participants in the trial and other persons who are in the administrative premises of the courts.

The content of administrative law was revealed as the regulator of public relations in the sphere of public administration. It helps to form the basic sources of judiciary reform, which primarily consists of changes in normative acts that violate the principle of judiciary independence, do not meet established international norms and make it impossible for Ukrainian citizens to have fairly protection. The rights and obligations are protected by the state. Therefore, the main impetus for judicial reform should be: the decision of the issue of appointment of judges in which the five-year term of office has expired, the increase of material support for judges, the increase of legal liability for unlawful interference with the activity of the judicial branch of power, etc.

There is an essential need to reform the judicial system of Ukraine and improve its individual institutions on the present stage of the formation of our state. The important aspects are the creation of an effective, inadequate and just judiciary, which should act for the benefit of Ukrainian citizens by providing rights and freedoms to everyone who needs it. In other words, administrative tools were developed in forms and methods of administrative activity of public administration and administrative procedures.

It was clarified that the improvement of administrative law norms in ensuring the judicial branch reform is a leading factor of guaranties the rights and freedoms of citizens. Moreover, the formation of Ukrainian statehood as a truly independent and democratic state at a high level should ensure justice and impartiality of every case.

It has been concluded the scientific content of the administrative and legal concepts of reforming the judiciary, which should serve the people of Ukraine to ensure constitutional rights and freedoms on the basis of the efficiency, independence and justice of each judicial authority. At the same time, the High Council of Justice should be the «supervisory» body of state power, which must monitor the observance of fundamental European and international principles of justice, not corrupt judges and the efficiency of the judicial system in general.

Otherwise, the High Council of Justice should take all necessary measures to stop the offenses by judges and eliminate further negative violations of the law, which in the future leads to gross violation of the rights and freedoms of citizens.

The special principles of the administrative and legal support for the reform of the judiciary are as follows: the principle of the adaptation of the current legislation, the principle of ensuring the court by highly qualified judges under the control of the High Council of Justice, the principle of proper logistical support, the principle of providing quality services to visitors, the principle of the safety of judges and court premises, the principle of timely upgrading of the staff of the court apparatus, the principle of proper material provision of judges and court staff, effective principle for corruption offenses.

For the first time, the administrative activity of the Public Council of Integrity was formed as the activities of its meetings, aimed at assessing the information gathered about a judge (candidate for a judge\'s position) and approval of official documents within its competence, such as the decision to provide information to the High Qualifications Commission of Judges of Ukraine, or conclusions about the unfairness of a judge (candidate) as a judge.

The peculiarities of Supreme Council of Justice activity is the interrelated set of tasks, administrative rights and duties aimed at ensuring independence and compliance with the laws by judges in order to ensure (protect) citizens\' rights to a fair trial. And in the implementation of the basic form of its activities, in particular the issuance of decisions, decisions and protocol decisions. The head of the High Council of Justice issues orders and orders as a form of administrative activity of different legal nature. The High Council of Justice has the right to make decisions regarding the violation of the requirements of incompatibility by a judge or prosecutor, a decision to dismiss a judge from office, a decision to suspend a judge from the administration of justice, a decision to transfer a judge from one court to another, the decision to terminate the resignation of a judge.

The concept, implementation of other legally significant actions in reforming the judiciary, was characterized by the following features: executive and administrative activities of the High Council of Justice, the High Qualifications Commission of Judges, the State Judicial Administration and the court apparatus, which have legal consequences and aims to resolve specific cases of administrative nature and publication of an official document (decision); refers to legally significant actions as a legal form of public administration in judicial power for the implementation of foundation, registration, certification, expert and jurisdictional activities; an example of institutional activity in judiciary is administrative action to establish the High Council of Justice, as a kind of implementation of legally significant actions that in the future will directly affect the independence of the judiciary.

It was clarified that the methods of administrative activity of the special public administration are means of purposeful influence of legal and organizational nature, which are based on the implementation of administrative and legal norms on the behavior of participants in administrative and legal relations in judiciary activity of ensuring independence and integrity of judges, and the functioning of the judicial branch of power in general, which makes it possible to protect citizens\' rights to just and humane justice.

It was revealed some methods of administrative cessation include some measures of administrative activity of the High Council for Justice, only this body has the right to submit a petition for consent to the detention of a judge, his detention or arrest (Article 58, paragraph 1, of the Law of Ukraine «On Higher Council of Justice»). Such a measure should be applied only after examining all the materials submitted by the law enforcement authorities (since the High Council of Justice has a significant responsibility for ensuring the independence of judges, preventing pressure on them, certain persons through professional activity or on personal grounds), a court with the exception of the detention of a judge under time or immediately after committing a grave or especially grave crime.

The foreign experience in reforming the judiciary was analyzed. It was revealed that in order to increase the level of rule of law and the efficiency of the functioning of the judiciary of Ukraine, there is a need to introduce into the judicial system the following components: the introduction of «mobile» courts, which provides an opportunity to effectively fight corruption, as the parties do not know judge, and the judge sees for the first time the case that he is considering; borrowing from the experience of other leading countries of the world, as it allows us to orientate in the fundamental human rights during the judicial protection and ensure the right to a fair trial; appointment of judges exclusively by bodies of judicial self-government for a term of office; development of administrative tools for increasing independence of the judiciary, transparency of the life of judges, while complying with the requirements for the immunity of judges; development of selection methods for the positions of judges of the most qualified, professional and patriotically-minded lawyers, as well as training and upbringing of judges; improvement of administrative procedures for bringing judges to disciplinary responsibility; definition of transparent and understandable procedures for the deprivation of immunity from judges based on the norms of administrative law; definition of administrative tools for checking the transparency of the life of judges outside the jurisdiction of the judiciary, with strict observance of the requirements for the immunity of judges.

It was established the main approaches of reforming and improvement of the legislation in administrative and legal support. The are some of them: the complex of administrative and legal measures of public administration, tasks, functions and duties, which can help to reform the judicial power by adoption amendments in legislation, which are guided the judiciary also uses for this administrative-legal mechanism.

It was proposed to adopt some amendments to the legislation regarding the decision of the five-year term of appointment of judges, since the parliament does not resolve this issue, we propose the introduction of mandatory amendments to the Law of Ukraine «On the Judiciary and Status of Judges», namely, Art. 70. («The procedure for the selection and appointment of a judge»), add the third subparagraph, which would be written as follows: according to the relevant decision of the High Qualifications Commission of Judges of Ukraine, it has the right to submit documents to the High Council of Justice regarding the appointment of a judge for a second time, after the expiration of his five-year term of office. And in the article 37 («Decision of the High Council of Justice on a candidate for a position of judge») of the Law of Ukraine «On the High Council of Justice», the following additions should be made in the fifth paragraph: the High Council of Justice may adopt a decision on recommending the President of Ukraine, appointment as a judge The second time after the expiration of his term of office for an indefinite period, upon submission of the High Qualifications Commission of Judges of Ukraine, after passing a special qualification assessment.
