Koretsky I.O. Principle of Competitiveness of the Parties in the Administrative Proceedings. - Qualifying scientific work on the rights of manuscripts.

On the basis of the author's research the concept of the principle of the adversarial parties in the administrative legal proceedings and its relation with other principles of the administrative process is analyzed. It is shown that the principles of the administrative legal proceedings are intended to carry out the following functions: regulating of social relations that arise when considering administrative cases by courts; contributing to the systematization of procedural legislation governing the procedure for the implementation of administrative legal proceedings; being of fundamental importance while interpreting norms and filling of gaps in the legal regulation of administrative proceedings; providing of logical construction of the institute of administrative legal proceedings; serving to effective protection and restoring of citizens' rights violated by the authorities and their officials.
When examining the issue of the principle of competition in the system of principles of administrative legal proceedings, it must be taken into account that the combination of the competitive basis of the administrative process with the parties' equality in the process provides discretionary ability to a complete use of the judicial protection of the rights, freedoms and interests of the person who appealed to the administrative court for protection. Objective interdependence and the connection of the principle of competition with the principles of administrative justice is clearly reflected in its ratio to the latter.
Thus, the condition for the implementation of the principle of competition is the procedural equality of the parties, because the parties can compete in defending their subjective rights and interests only if there are equal legal conditions and equal procedural means. In addition, the construction of administrative justice on the basis of the principle of competition gives the parties and those involved in the case more efficient use of the rights that belong to them in the administrative process, due to the principle of discretion. These principles are interconnected and have a mutual influence on each other.The principle of competition is a universal regulatory and governing requirement that is directly enshrined in the rules of procedural law, which ensures such a procedure for the implementation of legal proceedings, in which the court's finding of circumstances relevant to the case, is carried out through the confrontation of subjects of procedural relations in the presentation of circumstances on which they base their claims and objections.
The principle of competition in different types of process has certain peculiarities. In civil, criminal, administrative and economic proceedings, the parties compete for the actual circumstances relevant to the case and the legal qualification of these circumstances. At the same time, they are responsible only for the factual substantiation of their position. The question of the law the court decides independently. Despite the fact that the people involved in the case have the right, and in some cases, are obliged to give a legal substantiation of their claims and objections, the court is not bound by their arguments.
Nowadays the notion of "subject of power" is debatable, although its definition is provided in the Code of Administrative Justice of Ukraine. It is noted that the legislation of Ukraine lacks a unified list of subjects of power, and that is why to determine a certain body as such entity status and the content of its powers should be started with, and that status and powers are established by the relevant regulatory acts that regulate their activities.
In spite of the fact that in cases provided for by law, an administrative case may be instituted not only by the plaintiff, but also by the prosecutor and other persons who are granted the right to protect the rights and freedoms of other
persons, the plaintiff is always a person in defense of whose rights, freedoms and interests an administrative case is started.
A petition in administrative proceedings means an appeal of the participants of the administrative process to the court with the request for assistance in the implementation of the consolidated in the Code of Administrative Proceedings of Ukraine of their procedural rights and duties during the proceedings in a particular administrative case in order to protect their rights, freedoms and interests. The attention is drawn to the fact that the peculiarity of petitions in administrative proceedings is, firstly, the availability of an opportunity to petition any participant in the administrative process, and not only the parties; secondly, the petition is always brought to court and only the court is authorized to decide on its further realization - whether to satisfy it or not.
One of the powers of the court is the application by the authorities of the National Police of a properly summoned person whose personal participation is recognized by the court compulsory, a witness who, without good reason, did not arrive in the court session or did not report the reasons for non-arrival, with the reimbursement to the state's income of the costs of his implementation. In connection with the lack of specialized legislation regulating the work of the police, the normative settlement of this issue is proposed to supplement Part 1 of Art. 23 of the Law of Ukraine "On National Police", clause 9-1 of the following: "9-1) in cases and in accordance with the procedure established by law, upon a motivated decision of the authorized body or official, carries out the drive of the persons to whom it is applied."
On the basis of the analysis of different approaches, the author's definition of proving in administrative legal proceedings is suggested. It is offered to understand proving in administrative legal proceedings as the activity of the subjects of proving, which is regulated by the administrative-procedural norms, aimed at collecting, submitting, evaluating, reviewing, providing, researching, demanding or temporarily withdrawing evidence in order to find out the objective truth and fair solution to a public-legal dispute.
One of the factors in the implementation of the principle of competition between the parties, taking into account the procedural practice of the European Court of Human Rights, is the provision on the length of the trial. In order to establish a reasonable duration of a particular case in national judicial authorities, the European Court takes into account in its practice several defining criteria, in particular: the complexity of the case; the behavior of the applicant, that is, the person who applied for the protection of his or her rights; the work of the court and other state bodies of the state during the consideration of the case; importance of the subject matter for the applicant.
