SUMMARY

Nikulin V.A. Administrative and legal support of the activities of local self-government bodies on advertising issues. - The manuscript.

There is a scientific research in new solving the problem of administrative and legal support of the activities of local self-goverment bodies on advertising issues on the basis of the theory of administrative law, legislation, achievements of local self-government bodies. There were offered some results, suggestions and recommendations.

It is proved that local self-government bodies by the current legislation of Ukraine are empowered to regulate legal relations of the placement of outdoor advertising within settlements. Under the authority of local self-government bodies on advertising issues is understood as the right granted to them by the legislation of Ukraine in order to ensure equal, accessible, lawful and timely right of individuals and legal entities to acquire knowledge about business entities, goods and services, maintaining positive emotions, forming a positive attitude to business, with a balance of interests of citizens, advertisers, advertising distributors, local selfgovernment bodies and the state.

It has been established that under the current Law of Ukraine «On Advertising» the bodies of local self-government are not defined to the subjects of public administration, which monitor compliance with the legislation on advertising. Appropriate powers, for example regarding the protection of the rights and interests of citizens, enterprises, institutions and organizations, have not been provided. In this regard it is proposed to amend Article 26 of the said Law, supplementing the list of bodies that exercise control, by local authorities.

The administrative and legal support of the activities of local selfgovernment bodies on advertising issues is proposed to consider the totality of administrative and legal norms, through which local governments regulate and organize advertising legal relations, as well as provision by these standards of appropriate guarantees to these bodies for the realization of the tasks assigned to them and functions. The essence of the administrative and legal support of the activities of local self-government bodies in advertising matters is to create the appropriate conditions for the effective implementation of the authorities and officials of local self-government their powers, aimed to ensuring legality in advertising legal relations, providing amenities for settlements, filling local budgets, etc.

The study of the history of the formation and development of advertising showed that in each of the historical periods of time the state apparatus had a direct influence on the participants of advertising relations, established certain restrictions and rules of conduct.

The experience of administrative and legal support for the activities of public authorities and local authorities in Europe and the world in the field of advertising has shown that the regulation of advertising in the advanced economies has gone a long way to development. In the current conditions of the European vector of Ukraine's development it is necessary to adapt Ukraine's current legislation on advertising to the legislation of the European Union, to draw the experience of developed countries, taking into account national, economic and other peculiarities, imposing more severe sanctions for violating the legislation on advertising, providing local governments with the right to determine the amount, quantity and order of placing of outdoor advertising, having created an effective system of interaction of authorities with self-regulated organizations.

A balanced combination of self-regulation, state and public control will minimize the number of offenses in the field of advertising.

It is proved that in general the legal and normative basis of regulation of advertising legal relations has been formed in Ukraine. Local self-government bodies take an active part in regulating these legal relationships through the adoption of regulatory acts, the implementation of permitting and control activities. However the current legislation requires significant changes and additions, it does not meet the requirements of the present, does not contribute to the full development of a market economy.

It is determined that the normative and legal guarantees of the activities of local self-government bodies regulating the placement of advertising means a set of rules of law that are guaranteed or authorized by the state and local selfgovernment bodies and aimed at regulating relations of the placement of advertising in the territory of a certain administrative-territorial unit.

It is proposed to consolidate the right of local self-government bodies to impose administrative penalties, the procedure and grounds for prosecution at the legislative level. The list of administrative charges that can be applied to offenders in the field of advertising, it is proposed to distribute by subjects: the jurisdiction of local governments is to impose penalties in the form of fines, cancellation of permits for the placement of outdoor advertising and the forced dismantling of advertising media, the jurisdiction of courts - seizure of illegal proceeds, confiscation of an object that became an instrument of commission or a direct object of an administrative offense (in a claim of state authorities or local selfgovernment bodies).

It is determined that the control of local self-government bodies should be understood as regulated by the law of a set of measures, carried out by local authorities and aimed at ensuring compliance of advertising activities of business entities with the requirements of Ukrainian legislation on advertising.

It is proposed in order to provide local governments with real levers of influence on business entities to consolidate in the Law of Ukraine «On Advertising» such special grounds for cancellation of the permission for the placement of outdoor advertising: the lack of marking of a special design; installation of a special construction that does not comply with the permission for the placement of outdoor advertising; non-compliance with the requirements regarding the technical and/or aesthetic state of a special construction (in case of failure to comply with the written request of the authorized person to the control body); non-use of the special construction site for a continuous period of six months.

It is proved that in order to prevent mass distribution of advertising facilities without permission documents, which is damaging property, rights and interests of members of a territorial community, as well as inducing business entities to lawful conduct, it is expedient to add Article 16 of the Law of Ukraine «On Advertising» in such a paragraph: «The placement of outdoor advertising without permission is prohibited. In the case of the discovery of outdoor advertising that is placed without a permit (expiration of which has expired, canceled permit), it is subject to dismantlement on the basis of the corresponding decision of the executive body of the village, settlement, city council, and outside of the settlements - on the basis of the corresponding decision of the regional state administration in the procedure, established by these bodies on the basis of standard rules, approved by the Cabinet of Ministers of Ukraine».

The proposed definition of «dismantling of special structures» is a set of organizational and technical measures, aimed at separating a special construction from its location in order to move to a specially designated place for further accounting, storage and utilization.

It is proved that the organization of effective control of local selfgovernment bodies by the activity of subjects of advertising legal relations is possible in the presence of a transparent permitting system, clearly distributed and legally established powers between state authorities and local self-government bodies, an effective mechanism of bringing to legal responsibility, securing special reaction measures in the form of cancellation of permissions and dismantling of special constructions.

It was noted that an important part of the administration of local selfgovernment bodies is the provision of administrative services. Responsible missions are set up for local self-government bodies - the opening of centers for the provision of administrative services, the organization of their activities, the provision of interaction between permit authorities and administrators, the professional training of administrators, etc.

Taking into account the considerable amount of knowledge that an administrator should possess, there is a need for systematic training of administrators through the introduction of higher education institutions that train specialists in the field of public administration, specialty «administrator of the center for the provision of administrative services».

The gaps in the legal regulation of the provision of administrative services regarding changes in the permission to place outdoor advertising, its reregistration, extension of validity, cancellation, as well as the ways of their solution are revealed. It is substantiated the premature abandonment of Article 4-1 of the Law of Ukraine «On the Permit System in the Field of Economic Activity» in part with the abolition of the administrative service regarding the issuance of a duplicate of a permit-type document in the field of economic activity.

It is proved that the provision of administrative services by local governments, the realization of the tasks and functions assigned to them in cases, established by law, necessitates the conclusion of administrative contracts. The features, the subject structure and essential conditions of the contract on the use of the place that is in the communal property for the location of the advertising medium are determined.

The problem of placing advertising on transport was revealed and its solution was proposed by setting paragraph 13 of Article 1 of the Law of Ukraine «On Advertising» in the following wording: «advertising on vehicles - advertising placed on the outer and inner surfaces of vehicles» and according to the text of the law the words «advertising in transport» in all cases replace the words «advertising on vehicles».

Under the administration of local self-government, it is proposed to understand the legal norms regulated by the bodies and officials of local selfgovernment, which consists in the creation of an effective system of executive bodies, communal enterprises and institutions, management of communal property, monitoring of compliance with legislation, etc. in order to create conditions for the interests of territorial community, implementation of local and national programs and comprehensive development of the administrative-territorial unit.

The violations of the rights of co-owners of multi-apartment buildings were revealed and in order to guarantee their constitutional right to property, it was proposed to coordinate the placement of outdoor advertising with the involvement of the property of the co-owners of multi-apartment buildings by holding a general meeting of such co-owners and drawing up a corresponding protocol. By the decision of the general meeting of the co-owners of the multi-apartment building, the authority to grant the use of the place for the placement of outdoor advertising and the conclusion of the contract may be transferred to the head of the association of co-owners of the multi-apartment building by making appropriate changes to the charter.

It is substantiated that the detailed regulation of the procedure for dismantling the special designs of outdoor advertising should be reflected in Typical rules for placing outdoor advertising by introducing the proposed changes and additions. The filling of the gap in the legal regulation of the issue of distinguishing the sign (plaques) from the special design of outdoor advertising will contribute to the proposed changes to paragraph 48 of Typical rules for the placement of outdoor advertising.

Other amendments to the Code of Ukraine on Administrative Offenses, the Law of Ukraine «On Advertising», Typical rules for the placement of outdoor advertising, approved by the Resolution of the Cabinet of Ministers of Ukraine dated December 29, 2003 No. 2067, have been proposed, in compliance with the legislation on administrative services (permissive system in the field of economic activity), elimination of gaps and conflicts in legal regulation.
